By accessing or using Infographella ("the Service"), you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Infographella is an AI-powered service that transforms text content into visual infographics. The Service allows users to generate infographics in various formats optimized for different platforms including websites, social media, and presentations.

3. User Accounts

  • You must create an account to use the Service, which requires authentication through Google OAuth.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate, current, and complete information during registration.
  • You are responsible for all activities that occur under your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Credit System and Payments

  • Credits: The Service operates on a credit-based system. Each infographic generation consumes credits as specified at the time of generation.
  • Free Credits: New users receive 1 free credit upon registration.
  • Purchases: Credits can be purchased through Stripe payment processing. All purchases are final unless otherwise stated.
  • No Refunds: Credits are non-refundable and non-transferable. Unused credits do not expire but are tied to your account.
  • Pricing: We reserve the right to change credit pricing at any time. Changes will not affect credits already purchased.

5. Content and Intellectual Property

5.1 Your Content

  • You retain ownership of the text content you submit to the Service.
  • You grant us a license to use, process, and store your content solely for the purpose of providing the Service.
  • You represent and warrant that you have the right to submit the content and that it does not violate any third-party rights.

5.2 Generated Infographics

  • You own the infographics generated from your content.
  • You may use generated infographics for any lawful purpose, including commercial use.
  • Generated infographics are stored for 90 days from the generation date, after which they are automatically deleted.

5.3 Prohibited Content

You agree not to submit content that:

  • Is illegal, harmful, or violates any applicable laws
  • Infringes on intellectual property rights of others
  • Contains hate speech, harassment, or discriminatory content
  • Contains explicit sexual content or pornography
  • Contains personal information of others without consent
  • Is spam, malicious code, or designed to harm systems

6. Service Availability and Limitations

  • We strive to provide reliable service but do not guarantee uninterrupted or error-free operation.
  • The Service may be temporarily unavailable due to maintenance, updates, or technical issues.
  • We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
  • We are not liable for any loss of data or content resulting from service interruptions.
  • Generated infographics expire after 90 days and are automatically deleted.

7. AI-Generated Content

  • The Service uses artificial intelligence (Google Gemini API) to generate infographics.
  • AI-generated content may contain errors, inaccuracies, or unexpected results.
  • You are responsible for reviewing and verifying the accuracy of generated infographics before use.
  • We do not guarantee the accuracy, completeness, or quality of AI-generated content.
  • We are not liable for any consequences resulting from the use of AI-generated infographics.

8. Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to reverse engineer, decompile, or extract the source code of the Service
  • Use automated systems to access the Service without authorization
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to generate content that violates these Terms
  • Resell or redistribute access to the Service without authorization

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify, defend, and hold harmless Infographella and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the Service, your content, or your violation of these Terms.

12. Termination

  • You may terminate your account at any time by contacting us or deleting your account.
  • We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
  • Upon termination, your right to use the Service will cease immediately.
  • All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Infographella operates, without regard to its conflict of law provisions.
